Terms of Service

Welcome to ImagineBuddies. These Terms of Service ("Terms") govern your use of the ImagineBuddies service, including our website at imaginebuddies.com and our AI-powered phone call service (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Who May Use the Service

ImagineBuddies is designed for children ages 3–8 to use under parental supervision. The Service is intended for use by parents and guardians ("Subscribers") on behalf of their children. By subscribing, you represent that you are at least 18 years old and are the parent or legal guardian of any child using the Service.

2. Free Trial

New phone numbers receive 5 free AI character calls. This is a one-time trial per phone number and does not reset. After 5 free calls, a subscription is required to continue using the Service.

3. Subscriptions and Billing

• Subscriptions are billed at $9.99 per month.
• Billing is handled securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
• Subscriptions automatically renew each month until cancelled.
• You may cancel at any time through the dashboard or by contacting us. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods.

4. Account Access

Subscriber accounts are accessed using a phone number and a one-time SMS verification code. There are no passwords. You are responsible for keeping your phone number secure. If you believe your account has been accessed without authorization, contact us immediately.

5. The Service

ImagineBuddies provides AI-powered phone conversations between children and fictional characters (Piper Pig, Mickey, and Fairy Princess). All conversations are:

• Generated in real time using AI (Anthropic Claude).
• Governed by strict child safety rules that cannot be overridden by character personality.
• Recorded and stored as a transcript for your review in the parent dashboard.
• Limited in duration (5 minutes for free trial, 10 minutes for subscribers per call).

6. Child Safety

Child safety is our highest priority. Our AI system is designed to:

• Never request personal information from a child (name, address, school, phone number, etc.).
• Never suggest in-person meetings, secrets, or contact outside the Service.
• Immediately redirect conversations involving unsafe or distressing topics to a trusted adult.
• Maintain age-appropriate content suitable for children ages 3–8 at all times.

Despite these safeguards, no automated system is perfect. Parents should supervise their child's use of the Service and review call transcripts in the parent dashboard.

7. Acceptable Use

You agree not to:

• Use the Service for any purpose other than child entertainment and education.
• Attempt to manipulate or "jailbreak" the AI characters.
• Use the Service for any commercial purpose without written permission.
• Interfere with or disrupt the Service or its infrastructure.

8. Intellectual Property

All content, characters, and technology comprising the Service are owned by ImagineBuddies. You may not copy, reproduce, or distribute any part of the Service without prior written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful content, though we take significant steps to ensure quality and safety.

11. Limitation of Liability

To the fullest extent permitted by law, ImagineBuddies shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Changes to These Terms

We may update these Terms from time to time. We will notify Subscribers of material changes via SMS. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts of the United States.
